FCCPC Resumes Digital Lending Regulation After Court Affirms DEON Rules

The Federal Competition and Consumer Protection Commission (FCCPC) has resumed the implementation and enforcement of Nigeria’s Digital, Electronic, Online or Non-Traditional Consumer Lending Regulations, 2025 (DEON Regulations), following a Federal High Court judgment that upheld the Commission’s authority to regulate the country’s digital lending industry.

The decision comes after Justice A.L. Allagoa of the Federal High Court in Lagos dismissed a suit filed by the Wireless Application Service Providers Association of Nigeria (WASPAN), which had challenged the legality of the regulations. The court ruled that the DEON Regulations were validly issued under the FCCPC’s constitutional and statutory powers, while also setting aside the interim order that had temporarily restrained their enforcement.

With the judgment, the Commission said the legal barrier that led to the suspension of the regulations has now been removed, making the rules fully operational and enforceable across Nigeria.

Reacting to the ruling, FCCPC Director of Corporate Affairs, Ondaje Ijagwu, described the judgment as a victory for the rule of law and consumer protection. He noted that the Commission had complied with the court’s earlier interim order by suspending enforcement of the regulations and has now resumed implementation following the court’s final decision.

Ijagwu said the FCCPC remains committed to carrying out its statutory responsibilities professionally and in accordance with the law, stressing that the Commission will continue to promote a fair, transparent and accountable digital lending industry.

According to the FCCPC, the DEON Regulations were introduced to encourage responsible lending practices, improve regulatory oversight, eliminate unfair and exploitative activities by digital lenders, and strengthen consumer protection in Nigeria’s rapidly growing online lending sector.

The Commission added that the regulations are also aimed at creating a transparent regulatory environment that supports financial inclusion, encourages innovation and boosts confidence among consumers, investors and responsible digital lending operators.
